Protecting Human Rights in Complex Times

A Guide for Applicants

Asylum is a legal protection for individuals who have fled their home countries due to persecution. At Wang Law PLLC, we provide aggressive representation for those seeking safety in the United States.

Eligibility Criteria

To qualify, you must demonstrate a well-founded fear of persecution based on one of five protected grounds:

  1. Race
  2. Religion
  3. Nationality
  4. Political Opinion
  5. Membership in a Particular Social Group

*You must generally file within one year of your last arrival in the U.S.

The Process

  • Step 1: File Form I-589 with USCIS.
  • Step 2: Biometrics (Fingerprinting).
  • Step 3: Interview or Court Hearing.
    • Affirmative: Interview with Asylum Officer.
    • Defensive: Hearing before Immigration Judge.
  • Step 4: Decision.

Common Challenges

The asylum process is fraught with pitfalls. A single inconsistency in your statement can lead to a denial. Common issues include:

  • Missed Deadlines: Failing to file within the 1-year window.
  • Insufficient Evidence: Lack of documentation proving the threat in your home country.
  • Credibility Issues: Inconsistencies between written application and oral testimony.

Successful Asylum Grant

Once granted, asylees may:

  • Work immediately.
  • Petition for spouse and children (Form I-730).
  • Apply for a Green Card after 1 year.

Facing persecution requires a powerful defense.
