Visitor for Pleasure (B-2)

Tourism, Medical Care & Family Visitation

The B-2 classification is designed for temporary travel involving recreation, tourism, or medical treatment. Unlike the ESTA program, the B-2 visa allows for longer stays and is required for nationals of non-VWP countries.

⚠️ COMPLIANCE ALERT: “Remote Work” Scrutiny. While incidental administrative tasks are permitted, living in the U.S. while working remotely for a foreign employer often violates B-2 status intent.

Permissible Activities

Tourism & Social

Vacation, visiting friends/relatives, and participation in social conventions. Also covers amateur participation in musical or sports events (no payment allowed).

Medical Treatment

Strict financial vetting applies. Applicants must prove the ability to pay all medical costs upfront to avoid “Public Charge” inadmissibility determinations.

Incidental Study

Enrollment in a short recreational course of study (not for credit toward a degree) is permitted. Full-time study requires F-1 status.

Specialized B-2 Categories

  • Cohabiting Partners: Non-married partners of long-term nonimmigrants (e.g., H-1B, O-1 holders) may qualify for B-2 status for extended stays (per 9 FAM 402.2-4(B)(5)).
  • Elderly Parents: Often use B-2 for extended family visits (6 months), requiring strong proof of ties to the home country.
  • Denied ESTA Applicants: Individuals ineligible for the Visa Waiver Program must apply for B-2 and undergo consular interviewing.

Non-Immigrant Intent

The burden of proof falls on the applicant. You must demonstrate:

  • A residence abroad which you have no intention of abandoning.
  • Binding ties (property, family, job) ensuring your return.
  • Sufficient funds to cover the entire trip without working.
