EB-5 Investment Requirements

To qualify for the EB-5 Visa, investors must meet the following requirements:

  • Job Creation:
    • The investment must create at least 10 full-time jobs for U.S. workers.

  • Active Involvement:
    • Investors must engage in the management of the enterprise, either through direct involvement or as a policy-making investor.

EB-5 Visa Process

Step 1: Select an Investment Option

Investors can choose between:

  • Direct Investment – Actively managing a new business or investing in an existing enterprise.
  • Regional Center Investment – Investing in USCIS-approved regional centers, which pool funds into large-scale projects that meet EB-5 requirements.

Step 2: File Form I-526E (Immigrant Petition by Standalone Investor)

  • This petition demonstrates that the investor meets the program’s financial and job creation requirements.
  • Processing time varies but generally takes one to two years, depending on USCIS workload and priority date status.

Step 3: Adjustment of Status or Consular Processing

  • If already in the U.S., investors can apply for Adjustment of Status (Form I-485).
  • If outside the U.S., applicants must complete Consular Processing and attend an interview at a U.S. embassy.

Step 4: Receive a Conditional Green Card

  • Investors initially receive a conditional green card valid for two years.

Step 5: File Form I-829 (Petition to Remove Conditions)

  • Within 90 days before the conditional green card expires, investors must file Form I-829 to prove job creation and maintain lawful investment.
  • Once approved, the investor and their family receive permanent U.S. green cards.

EB-5 Visa Processing Time

Processing times for the EB-5 visa depend on USCIS workload and visa backlogs.

  • Form I-526E Processing: 12 to 24 months
  • Form I-485 (Adjustment of Status): 8 to 14 months
  • Consular Processing: 6 to 12 months
  • Form I-829 Processing (Removing Conditions): 24 to 48 months
