EB-1A Extraordinary Ability

The “Gold Standard” Green Card for Top Talent

The EB-1A classification is a first-preference employment-based green card. It requires no employer sponsorship and no PERM labor certification, making it the ultimate pathway for individuals at the top of their field.

⚠️ STRATEGY ALERT: The “Two-Step” Review.
Meeting 3 out of 10 criteria is just the first step. The real challenge is the “Final Merits Determination” (Kazarian Review), where USCIS decides if you have sustained national acclaim.

*Note for China/India born applicants: Visa retrogression currently applies. Consult us for timing strategies.

The 10 Regulatory Criteria

You must meet at least 3 of the following (unless you have a one-time major award like a Nobel Prize):

Impact & Authorship

  • Scholarly Articles: Published papers in professional journals.
  • Original Contributions: Major significance in the field.
  • Media Coverage: Published material about you in major media.

Role & Recognition

  • Awards: Nationally recognized prizes for excellence.
  • Judging: Evaluating the work of others (Peer review).
  • Critical Role: Leading role in distinguished organizations.
  • Membership: Associations requiring outstanding achievement.

Commercial Success

  • High Salary: Significantly higher remuneration than peers.
  • Commercial Success: Box office receipts or sales (Arts).
  • Exhibitions: Display of work at artistic showcases.

Fast-Track Timeline

EB-1A is unique because it allows for Premium Processing.

  • I-140 Decision: 15 Calendar Days (with Premium Processing fee).
  • Regular Processing: 6 to 12 Months (varies by Service Center).
  • Self-Petition: You file for yourself; no job offer is needed.
