Family Sponsorship Guide

A Detailed Roadmap for Spouses, Parents, Children & Siblings

U.S. immigration law divides family members into two distinct categories: Immediate Relatives (Unlimited Visas) and Preference Relatives (Subject to Annual Caps). Understanding which category your relative falls into is the first step to estimating the timeline.

1. Sponsoring a Spouse (Marriage-Based)

This is the most common path, but the rules differ significantly depending on the sponsor’s status.

If Sponsor is a U.S. Citizen
  • Category: Immediate Relative (IR-1/CR-1).
  • Wait Time: No visa backlog. Processing takes ~12-18 months.
  • Inside U.S.: Can file concurrently (I-130 + I-485) for immediate adjustment.
  • Conditional Status: If married < 2 years, you get a 2-Year Conditional Green Card. You must file Form I-751 later to remove conditions.
If Sponsor is a Green Card Holder
  • Category: F-2A Preference.
  • Wait Time: Subject to Retrogression. Even spouses now face a wait time (check Visa Bulletin).
  • Inside U.S.: Cannot file I-485 until the “Priority Date” is current. The beneficiary must maintain valid status (e.g., F-1, H-1B) while waiting.

2. Sponsoring Parents

Who Can Sponsor: Only U.S. Citizens (must be at least 21 years old).
Who Cannot Sponsor: Green Card holders cannot sponsor parents.

Key Rule: No Derivative Beneficiaries

Parents are “Immediate Relatives,” meaning they cannot bring their other children (your siblings) on the same petition.

Example: If you sponsor your mother, your 15-year-old brother cannot tag along. You must wait for your mother to get her Green Card, and then she can sponsor her child (F-2A), or you can sponsor your sibling separately (F-4, very long wait).

3. Sponsoring Children

Age and marital status determine everything.

Under 21 & Unmarried

Immediate Relative (IR-2). Fastest category. No visa limit.

Over 21 & Unmarried

F-1 Preference. Significant wait times (7+ years depending on country).

Married (Any Age)

F-3 Preference. Only U.S. Citizens can sponsor married children. Long wait times.

⚠️ CSPA Warning (Aging Out): The Child Status Protection Act helps freeze a child’s age, but calculation is complex. Under new 2025/2026 USCIS policy, the “Final Action Date” chart is strictly used, causing more children to “age out.” Consult an attorney early.

4. Sponsoring Siblings (Brothers/Sisters)

  • Who: Only U.S. Citizens (21+) can sponsor.
  • Category: F-4 Preference.
  • Derivatives: Unlike parents, siblings CAN bring their spouses and minor children on the same petition.
  • Wait Time: Extremely long (15-20+ years for most countries; longer for Mexico/Philippines).

Strategic Tip:
Since the wait is so long, it is often better to file ASAP to “lock in” a priority date, even if plans change later.

The Financial Pledge

Every family-based case requires an Affidavit of Support (Form I-864). This is a legally binding contract between the sponsor and the U.S. government.

  • Income Requirement: Sponsor must earn 125% of the Federal Poverty Guidelines.
  • Joint Sponsor: If income is insufficient, a Joint Sponsor (U.S. Citizen/LPR) can be used.
  • Responsibility: The sponsor agrees to support the immigrant and reimburse the government for any means-tested public benefits used.
