2026 Policy Overhaul: Wage-Based Selection & New Fees
The H-1B visa allows U.S. employers to hire foreign professionals in specialty occupations. However, the landscape has shifted dramatically for the FY 2027 Cap Season (March 2026 Registration). The era of “random lottery” is ending, replaced by a system that prioritizes higher salaries and strictly regulates consular processing.
⚠️ 2026 H-1B REFORM ALERTS
1. Wage-Weighted Selection
Effective Feb 27, 2026: The “random” lottery is being replaced by a weighted system. Registrations for Level IV (highest wage) positions get 4x entries; Level I (entry-level) get only 1 entry. This drastically reduces the odds for entry-level jobs.
2. Consular “Home Country” Rule
Domestic Visa Renewal (in the U.S.) has ended. All first-time H-1B stamping must be done at a U.S. Consulate abroad, typically in your home country. New strict vetting applies to “Third-Party Placement” roles.
Beneficiary-Centric Registration: To stop fraud, each employee gets only ONE lottery profile, regardless of how many employers register them. Multiple registrations no longer increase your chances.
The New Selection System (FY 2027)
USCIS now prioritizes petitions based on the Department of Labor (DOL) Wage Levels. Your odds of selection are mathematically tied to the salary offered compared to the local prevailing wage.
- Level IV & III: High Priority (Senior/Expert roles). Very high chance of selection.
- Level II: Moderate chance.
- Level I: Entry-level wages. Lowest priority. (Strategic Tip: Employers may need to artificially raise salaries to Level II to be competitive).
The Quota (Cap)
- Regular Cap: 65,000 Visas
- Master’s Cap: 20,000 Visas (U.S. Advanced Degrees only)
- Exceptions: Singapore & Chile (6,800 reserved)
New Employer Costs (2026)
Employers must cover all H-1B costs. The fee structure has increased significantly to fund the asylum program.

Common H-1B Questions
Can I petition from my home country?
Yes, via Consular Processing. However, be aware of the new $100,000 supplemental fee rule that applies to certain petitions filed from abroad (check with us for exemptions). Stamping must be done at a consulate; domestic renewal is currently suspended.
How long is the visa valid?
Initial approval is for 3 years, extendable to a maximum of 6 years. Extensions beyond 6 years are possible ONLY if you have an approved I-140 (Green Card petition) or a pending PERM >365 days.
Who is Cap-Exempt?
Universities, non-profit research orgs, and government research entities are exempt from the lottery. They can file H-1Bs year-round without worrying about the wage-weighted selection.
