National Interest Waiver (NIW)
EB-2 Green Card: No Employer • No PERM • Self-Petition
The National Interest Waiver (NIW) is a special category of the EB-2 Green Card that allows foreign nationals to self-petition for permanent residence without a job offer or a labor certification (PERM). It is designed for individuals whose work is of such “national importance” that the U.S. government waives the requirement to test the labor market.

1. The 3-Prong Test (Matter of Dhanasar)
To qualify, you must satisfy the three prongs established in the landmark case Matter of Dhanasar (2016).
Prong 1: Substantial Merit & National Importance
The Question: Is your proposed work important to the U.S. generally?
- Fields: Business, Science, Technology, Health, Culture, or Education.
- Scope: The impact must be broader than just one client or one company. It should affect the industry or the nation.
- Evidence: Industry reports, government interest letters, media coverage.
Prong 2: Well-Positioned to Advance
The Question: Are YOU the right person to do this work?
- Credentials: Advanced degrees (Master’s/PhD) or exceptional ability.
- Track Record: Citations, patents, commercialized products, major contracts, or investment funding.
- Evidence: CV, degree evaluation, citation report (Google Scholar), reference letters.
Prong 3: Balance of Interests
The Question: Why should we skip the labor market test?
- Urgency: Is the work too urgent to wait for PERM (e.g., COVID research, AI competitiveness)?
- Job Creation: Will you create jobs for US workers (Entrepreneurs)?
- Self-Employment: Is the nature of the work impractical for a traditional job offer?
STEM & Entrepreneurs
Since Jan 2022, USCIS has specific guidance favoring STEM graduates (especially PhDs) and Entrepreneurs.
- STEM: Work in “Critical and Emerging Technologies” (AI, Quantum, Biotech) is presumed to be of national importance.
- Entrepreneurs: Incubator backing or VC funding can prove you are “well-positioned.”
Physician NIW (PNIW)
A separate statutory track for doctors.
- Requirement: Work full-time for 5 years in a shortage area (HPSA/MUA) or VA facility.
- Benefit: Unlike regular NIW, approval is mandatory if criteria are met (not discretionary).
- Specialists: Both Primary Care and Specialists are eligible (thanks to Schneider v. Chertoff).
