O-1 Extraordinary Ability Visa
For Top Talent in Science, Business, Arts & Athletics
The O-1 visa is the premier non-immigrant visa for individuals who possess “extraordinary ability.” Unlike the H-1B, there is no cap (quota), it can be extended indefinitely, and you can start working immediately upon approval. It is the preferred visa for artists, entrepreneurs, doctors, and athletes at the top of their fields.

The Standard: You must demonstrate you are one of the small percentage who has risen to the very top of the field. You need a major international award (like a Nobel Prize) OR at least 3 of the following 8 criteria:
- 🏆 Prizes: Nationally recognized prizes or awards.
- 👥 Membership: Associations requiring outstanding achievement.
- 📰 Press: Featured in professional or major trade publications.
- ⚖️ Judging: Participation as a judge of the work of others.
- 💡 Contributions: Original scientific/business contributions of major significance.
- 📝 Authorship: Scholarly articles in professional journals.
- 🏢 Critical Role: Essential capacity for distinguished organizations.
- 💰 High Salary: Commanding a high salary compared to peers.

O-1B: Arts, Film & TV
The Standard: You must demonstrate “Distinction” (prominence). You need a major award (Oscar, Emmy, Grammy) OR at least 3 of the following 6 criteria:
- ⭐ Lead/Starring Role: In productions with a distinguished reputation.
- 📰 Critical Reviews: National or international recognition in major media.
- 🏢 Key Role for Organizations: Lead role for distinguished organizations/establishments.
- 📈 Commercial Success: Box office receipts, ratings, or standing in the field.
- 👏 Recognition: Significant recognition from organizations, critics, or experts.
- 💰 High Salary: Commanding a high salary compared to others in the field.
The “Peer Group” Opinion
Mandatory Requirement: Before filing, you must obtain a written “Advisory Opinion” from a U.S. peer group or labor union (e.g., SAG-AFTRA for actors).

Agent vs. Employer
Freelancers Take Note: If you work for multiple clients (e.g., an actor or designer), you should file through a U.S. Agent instead of a single employer. This allows you to work on various projects listed in your itinerary.
Support Staff & Family
O-2 Essential Support
For assistants, coaches, or makeup artists who are “integral” to the O-1’s performance. They must have critical skills that cannot be performed by a U.S. worker.
O-3 Dependents
Spouses and children under 21. They can live and study in the U.S. but generally cannot work.
