Bringing Your Family Together in the U.S.

For U.S. Citizens, parents are considered “Immediate Relatives.” This is the highest priority category in immigration law, meaning there is no annual cap and generally no waiting list for a visa number.

However, the process involves strict financial sponsorship requirements and scrutiny of your parents’ past immigration or political history.

Part 1: Who Can Be Sponsored?

Can Green Card Holders Sponsor Parents?

No. Only U.S. Citizens (at least 21 years old) can petition for their parents. Permanent Residents (LPRs) cannot.

What About Step-Parents?

Yes, if… the marriage creating the step-relationship occurred before you turned 18. If they married after your 18th birthday, you cannot sponsor them as a step-parent.

Can My Siblings Come Too?

No. The IR-5 category does not allow “derivative beneficiaries.” Your minor siblings cannot tag along. You must apply for them separately (F4 category, which has a long wait).

Part 2: Process & Financials

Two Ways to File

A. Parents are Abroad (Consular)

File Form I-130. Once approved, the case moves to the National Visa Center (NVC) and then the local U.S. Consulate for an interview. Timeline: ~12-18 months.

B. Parents are in the U.S. (Adjustment)

If they entered legally (e.g., B1/B2), they may be able to file I-130 and I-485 concurrently.

Warning: Filing too soon after entry can trigger “Visa Fraud” accusations regarding intent. Consult a lawyer.

The I-864 Affidavit of Support

You must prove you can support your parents at 125% of the Federal Poverty Guidelines.

  • Household Size: Includes you, your spouse, your dependents, AND the parent(s) you are sponsoring.
  • Not Enough Income? You can use assets (savings/stocks) or a Joint Sponsor.
  • Living Abroad? If you live outside the U.S., you must prove “Domicile” (intent to return to the U.S.) to be a sponsor.

⚠️ Risk Factors to Watch

  • Prior Overstays: If your parent previously overstayed a visa, they might be barred from re-entering (3 or 10-year bar), unless applying for Adjustment of Status inside the U.S.
  • Party Membership: Past membership in certain political parties (e.g., CCP) can be a ground for inadmissibility. A detailed statement or waiver may be required.
  • Public Charge: While the strict 2019 rule is gone, you still must prove your parents won’t rely on welfare.
