Investment Requirements
Targeted Employment Area (TEA)
$800,000
The Preferred Route.
Investment in a rural area or an area with high unemployment (150% of national average). Most Regional Center projects are structured to qualify for this lower threshold.
Standard Investment
$1,050,000
Non-TEA Projects.
For investments in prosperous urban areas that do not qualify as TEAs. The requirement is higher, but allows flexibility in location choice for Direct Investors.
Choose Your Path: Regional Center vs. Direct
Regional Center (Passive)
95% of applicants choose this. You invest in a large project (hotel, resort, housing) managed by a USCIS-designated Regional Center.
- Role: You are a Limited Partner (hands-off).
- Job Creation: Indirect and Induced jobs count (easier to prove).
- Exit: Capital is typically returned after 5-7 years.
Direct Investment (Active)
You invest in your own business or a specific enterprise you control.
- Role: You manage the business.
- Job Creation: You must directly hire 10 full-time W-2 employees.
- Exit: Your capital is tied to the business success.
⚠️ The Critical Step: Source of Funds
USCIS does not just want your money; they want to know exactly where it came from. The #1 reason for EB-5 denial is failure to prove the “Lawful Source of Funds.”

New Benefit: Concurrent Filing
Under the 2022 Reform Act, if you are already in the U.S. on a valid visa (e.g., H-1B, F-1), you can now file your Green Card Application (I-485) at the same time as your EB-5 Petition.
Why is this huge? It allows you to apply for a Work Permit (EAD) and Travel Document (AP) immediately, giving you freedom to work and travel years before the Green Card is officially approved.
